Terms of service
These terms govern your use of fadedcollective.com and any purchase you make from The Faded Collective. By using this site or placing an order, you agree to them. Please read them before you buy.
1. Who we are
The Faded Collective ("we", "us", "our") operates this site and sells professional barber supplies and the Fade the World product line. Our address is 1713 N College Ave Suite 3, Bloomington, IN 47404, United States.
2. Using this site
You must be at least 18 years old, or the age of majority where you live, to purchase from us. You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorized access to it, and not to interfere with its operation or security.
We may refuse service, cancel an order, or limit quantities at our discretion — for example where we suspect fraud, reseller activity, or a pricing error.
3. Products, pricing and availability
All prices are in US dollars and exclude tax and shipping unless stated otherwise. Prices and product availability can change without notice.
We work hard to display products accurately, but we can't guarantee that your screen shows colours and finishes exactly as they appear in person, and manufacturers occasionally revise packaging or specifications without telling us.
If an item is listed at an incorrect price or with an incorrect description, we reserve the right to cancel the order — even after it has been confirmed — and will refund you in full.
4. Orders and payment
Your order is an offer to buy. A confirmation email acknowledges we received it; the contract forms when we dispatch the goods. We may cancel before dispatch and refund you in full.
You confirm that any payment method you use is yours and that the billing details you give us are accurate and complete.
5. Professional tools — use them properly
Much of what we sell is professional equipment: clippers, trimmers, shavers, blades and shears. They are sharp, they are powered, and they are intended for use by trained barbers and stylists in line with the manufacturer's instructions and your local licensing and sanitation rules.
You are responsible for using, cleaning, sanitising and maintaining these tools safely, and for complying with the health and safety regulations that apply to your shop. We are not liable for injury, loss or damage arising from misuse, improper sanitation, unauthorised modification, or use contrary to manufacturer instructions.
6. Shipping and returns
Delivery is covered by our Shipping Policy and returns by our Refund Policy. Both form part of these terms.
7. Warranties
Products carry the warranty offered by their manufacturer, on the manufacturer's terms. Beyond that, and except where US or Indiana law says otherwise, the site and everything on it are provided "as is" and "as available" without warranties of any kind, express or implied.
Nothing in these terms limits your statutory rights as a consumer, or excludes liability for death or personal injury caused by our negligence, or for fraud.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses — including lost profits, lost bookings or lost revenue — arising from your use of the site or any product bought through it. Where liability cannot be excluded, it is limited to the amount you paid for the order in question.
9. Intellectual property
The Faded Collective and Fade the World names, logos, product photography and site content belong to us and may not be reproduced or used commercially without written permission. Third-party brand names and trademarks belong to their respective owners and are used to identify the products we sell.
10. Your content
If you send us reviews, photos, comments or suggestions, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish them in connection with our business. You confirm the content is yours to share and isn't unlawful or defamatory. We may edit or remove it at our discretion, and we're under no obligation to keep it confidential.
11. Third-party links
The site may link to third-party sites we don't control. We're not responsible for their content, policies or practices.
12. Privacy
How we handle your personal information is set out in our Privacy Policy.
13. Indemnity
You agree to indemnify and hold harmless The Faded Collective and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.
14. Changes to these terms
We may update these terms at any time by posting a revised version on this page. The version published when you place an order is the one that applies to it. Please check back periodically.
15. Governing law
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Monroe County, Indiana.
16. Severability and entire agreement
If any provision is found unenforceable, the remainder stays in force. These terms, together with our Shipping, Refund and Privacy Policies, are the entire agreement between us and supersede any earlier understanding.
